Acceptable Use Policy

§1 General Provisions

1. This Acceptable Use Policy ("AUP") governs the use of the wingman.pm platform ("Service" or "Platform") provided by WEBSOMNIA Juliusz Michajłow ("Company").

2. This AUP is binding upon all users of the Service, including freemium, paid, and trial accounts.

3. This AUP forms an integral part of our Terms of Service and should be read with our Privacy Policy and other applicable policies.

4. By accessing or using the Service, you agree to this AUP, applicable Polish law, EU regulations including GDPR, and international standards.

5. Violations may result in suspension or termination as detailed in §8.

§2 Acceptable Use Principles

• Lawful Business Purposes: Use the Service only for lawful business purposes related to product management and feedback analysis.
• Professional and Ethical Conduct: Conduct yourself professionally and ethically, respecting the rights of others.
• Account Security: You are responsible for securing your credentials and all activities under your account.
• Legal Compliance: Comply with all applicable laws, regulations, and industry standards.
• Responsible AI Usage: Ensure data you input is appropriate and you have the necessary rights to process it.

§3 Prohibited Activities

3.1 Unlawful Activities

• Distribute unlawful, harmful, or objectionable material.
• Infringe intellectual property rights.
• Distribute pornographic, violent, discriminatory, or inappropriate content.
• Engage in hate speech, harassment, or discrimination.
• Violate privacy rights or distribute personal information without consent.
• Facilitate fraud, money laundering, or other financial crimes.

3.2 Technical Abuse and Security Violations

• Attempt unauthorized access to systems, servers, or networks.
• Circumvent or interfere with security features.
• Introduce malware or malicious code.
• Conduct DoS/DDoS attacks.
• Scan for vulnerabilities without written authorization.
• Reverse engineer, decompile, or disassemble our software.
• Abuse APIs beyond authorized limits or disrupt infrastructure.
• Prompt injection attacks or attempts to bypass AI safety measures.

3.3 Resource Abuse

• Exceed API rate limits.
• Manipulate or circumvent token limitations.
• Conduct unauthorized web scraping.
• Generate artificial or excessive traffic.
• Use infrastructure for cryptocurrency mining or similar activities.
• Create multiple accounts to bypass limitations.
• Store excessive data beyond allocated quotas.

3.4 Commercial Violations

• Resell, sublicense, or redistribute the Service without authorization.
• Use the Service to develop competing products or services.
• Conduct competitive intelligence that violates our terms.
• Engage in mass data harvesting for commercial purposes.
• Provide third-party services using our platform without authorization.
• Circumvent payment obligations or attempt to defraud billing.

3.5 Community and Social Violations

• Impersonate individuals, organizations, or entities.
• Distribute spam or unsolicited communications.
• Harass, stalk, or intimidate other users.
• Share account credentials or allow unauthorized access.

§4 Security and Data Protection

• Account Security: Maintain strong, unique passwords and enable MFA when available.
• Password Requirements: At least 12 characters including letters, numbers, and special characters.
• Vulnerability Reporting: Report security issues to hello@wingman.pm; do not exploit them.
• GDPR Compliance: Ensure appropriate legal bases for processing personal data.
• Data Breach Notification: Notify us immediately of unauthorized access or disclosure of personal data.
• Confidential Information: Protect confidential information and avoid unauthorized disclosure.

§5 Resource Usage

• Fair Use Policy: Use resources reasonably and per standard business practices.
• Rate Limiting: API requests are subject to plan-based limits; exceeding may lead to suspension.
• Storage Quotas: Respect allocated storage; excessive use may incur charges or limitations.
• Bandwidth: Avoid activities that consume excessive bandwidth or impact others.
• Automated Access: Follow API documentation and rate limits.
• Token Usage: Tokens are subject to plan terms; see Terms of Service for allowances.

§6 Intellectual Property Rights

• Company IP: All intellectual property in the Service belongs to the Company or licensors.
• User Content Ownership: You retain ownership of content you upload; you grant us a license to use it to deliver services.
• License Grant: Non-exclusive, worldwide, royalty-free license for service delivery.
• Third-Party Rights: Respect others' IP rights and ensure appropriate permissions.
• Copyright Compliance: Do not use the Service to infringe copyrights.

§7 Monitoring and Enforcement

• We may monitor usage to ensure compliance and maintain quality and security.
• We may investigate suspected violations and take appropriate action.
• Automated systems may detect abuse and security threats.
• Monitoring is conducted in accordance with our Privacy Policy and applicable laws.
• We may cooperate with law enforcement in investigating illegal activities.
• No general monitoring obligation, but we reserve the right to act when necessary.

§8 Consequences of Violations

• Progressive Enforcement: Consequences escalate based on severity and frequency.
• First Violation: May result in a written warning with 7 days to correct.
• Repeated Violations: May result in temporary suspension (7–30 days) and feature restrictions.
• Serious Violations: Severe issues may result in immediate suspension or termination without notice.
• Legal Violations: Activities violating laws may be reported to authorities and prosecuted.
• Refunds: Accounts terminated for policy violations are generally not eligible for refunds except where required by law.
• Legal Remedies: We reserve the right to pursue all available legal remedies.

§9 Reporting Violations

Report suspected violations to hello@wingman.pm with relevant details and evidence.

We will acknowledge receipt within 24 hours and aim to complete investigations within 7 business days. Good faith reporters are protected from retaliation; false or malicious reports may constitute a violation.

§10 Policy Changes

We may modify this AUP to reflect changes in services, legal requirements, or business practices. We will provide at least 30 days' advance notice of material changes via email and by posting the updated policy.

Continued use after the effective date constitutes acceptance. If you disagree, you may terminate your account per the Terms of Service.

§11 Final Provisions

• Governing Law: Polish law governs this AUP.
• Jurisdiction: Disputes are subject to the courts in Warsaw, Poland; consumer jurisdiction follows applicable consumer laws.
• Severability: If any provision is invalid, the remaining provisions remain in effect.
• Entire Agreement: This AUP, together with our Terms of Service and Privacy Policy, constitutes the entire agreement regarding acceptable use.
• Integration: This AUP supplements and is incorporated by reference into our Terms of Service.
